1. Who we are

2. Scope

These terms apply to all offers, instructions and agreements between Machinery JoBo and the customer, unless expressly agreed otherwise in writing.

3. Offers and prices

  • All stock shown on this website is without obligation and subject to prior sale.
  • The website shows no prices. Prices are provided solely on request, in an individual quote.
  • A quote is valid for 14 days, unless it states a different period.
  • Our quote states clearly what is included, including transport and the cost of paperwork.

4. Formation of the agreement

An agreement is formed once the customer accepts a quote in writing or by email and we have confirmed that acceptance.

5. Sourcing and purchasing in Germany

When carrying out a search request we act on the customer's instruction. We select, inspect and negotiate, but the final decision to buy rests with the customer. We report on the condition of a vehicle to the best of our knowledge; we are not an inspection body and do not issue a technical certification unless separately agreed.

6. Payment

  • Payment follows the terms stated in the quote or invoice.
  • Delivery takes place after payment in full, unless agreed otherwise.
  • For business customers within the EU, delivery with reverse-charge VAT is possible provided the VAT number supplied is valid and verified.

7. Delivery and transport

  • Stated delivery times are indicative and never binding deadlines.
  • Risk passes to the customer at the moment of actual delivery.
  • Delays in transport or in the issuing of papers by third parties give no right to rescission or compensation.

8. Condition of used vehicles

Machinery, trucks and cars are sold used. Signs of use and normal wear are part of that and do not constitute a defect. We describe the condition as completely as possible and report known defects in advance. The customer always has the right to inspect, or have inspected, the vehicle before delivery.

9. Warranty

For used vehicles, only the warranty recorded in the quote or purchase agreement applies. Where no warranty clause is included, the vehicle is sold without warranty against technical defects, without prejudice to the mandatory rights a consumer has under the law.

10. Liability

Our liability is limited to the amount invoiced for the instruction concerned. We are not liable for consequential loss, lost profit or business interruption. This limitation does not apply in the event of intent or deliberate recklessness.

11. Paperwork and registration

We arrange the German export documents and supply the papers required in the Netherlands. The customer is responsible for the final registration, insurance and use in accordance with the applicable rules.

12. Right of withdrawal

Consumers buying at a distance have fourteen days to withdraw, unless the vehicle was purchased to their specification or clearly selected to order. We explain per instruction whether the right of withdrawal applies.

13. Complaints

Please report complaints within fourteen days of delivery, in writing and describing the defect, to contact@machinery-jobo.biz. We respond on the substance within fourteen days.

14. Governing law

All agreements are governed by Dutch law. The Vienna Sales Convention is excluded. Disputes are submitted to the competent court in the district where we are established, unless mandatory law provides otherwise.
